Our last look at “From Debt to Riches” by Phumelele Ndumo

Before granting a garnishee order, court officials are supposed to establish that the debtor will still have enough money to live on after the garnishee order. However, many officials do not conduct this affordability assessment; employees end up applying for staff loans or micro loans and putting themselves into further debt, because the affordability assessment was not done.

So if your employee will end up taking home less money than he or she can live on because of the garnishee order. then the employer should advice the employee to go to court to have the garnishee amount reduced. The employee will be liable for legal fees.

You can contact the Credti Ombud on 0861 662 837 or ombud@creditombud.org.za if you are affected by an invalid garnishee order. They offer services free of charge to the public.
